The general rule applies not only to construction and construction contracts, but to all types of contractual agreements. It is clear that some work can be done in anticipation of an agreement, without this behaviour being tantamount to accepting the terms of an agreement. However, this case suggests that the larger and longer the work, the harder it becomes to resist the conclusion that the parties intended to be related. .
